RM:  Recap of the ordinance as it applies today to this applicant.

Town of Otisfield Shoreland Zoning Ordinance, Section 12, 1,a,:

“After January 1, 1989, if any portion of a structure which is less than the required setback from the normal high-water line of a water body or upland edge of a wetland, that portion of the structure shall not be expanded in floor area or volume by thirty percent (30%) or more during the lifetime of the structure.”

NOTES:

This thirty percent (30%) limitation applies only to that portion of a structure that is within the 100’ setback area.

The complete Section 12, Letter C should be read in its entirety for clarity and interpretation.

3.      Introduction of any consultants attending on behalf of the Planning Board.
(Not in attendance at this time per the recommendation of the Board)

        Only applicants, PB members, Secretary, and CEO were in attendance.   
                                                                                
5.      Discussion & Comments:

Site Walk was opened by RM and turned over to Kenneth & Kathleen Bailey.   Ken: At one time this land consisted of  (2) lots. Currently it is a combined single lot.  (1) Lot was purchased in 1983 and the other lot was purchased in the early 90’s. Currently structure is on posts. Applicant would like to move structure and place it on a full foundation. This would move structure approx. 20’ further back from water and closer to CMP wires. Currently structure is 45’ from the water. The proposed foundation would be 24’ x 40’. Currently it is a seasonal camp, if proposed plan is accepted, structure would be livable year round. Moving the structure where applicant is proposing would still be within the 100’ setback. RM: If application is accepted, revegetation would be necessary. RM: Greatest Practical Extent” needs to be addressed by the Board. CEO: Applicant and CEO may disagree on interpretation of calculation of square feet & cubic feet. NOTE: Board thoroughly walked the site & structure, and discussed with the applicants the process including DEP involvement. Applicant asked about the appeal process.  RM reviewed.
